These Terms of Service ("Terms") govern your use of the ShiftProfit mobile application ("the App"), operated by ShiftProfit LLC ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, please do not use the App.
ShiftProfit is a productivity and tracking tool for gig and rideshare drivers. It helps you log shifts, mileage, earnings, and expenses across multiple driving platforms, and provides calculated estimates such as net pay, hourly rate, and mileage-based tax write-off figures based on the information you enter.
ShiftProfit is not a tax firm, accounting firm, financial advisor, or law firm, and nothing in the App constitutes tax, financial, legal, or professional advice. All figures shown in the App — including but not limited to net pay, hourly rate, take-home percentage, mileage deductions, and tax write-off estimates — are calculations based solely on the data you enter and standard public formulas (such as the IRS standard mileage rate). These figures are estimates only and may not reflect your actual tax liability, deductible expenses, or take-home earnings.
You are solely responsible for verifying any figures before relying on them, filing taxes, or making financial decisions. We strongly recommend consulting a qualified CPA, tax professional, or financial advisor regarding your specific situation. We disclaim all liability for decisions made, penalties incurred, or losses suffered based on information or estimates provided by the App.
The App relies entirely on data you manually enter (odometer readings, pay amounts, tips, expenses, etc.). We do not verify the accuracy of this information. Calculations are only as accurate as the data provided, and you are responsible for entering information correctly.
ShiftProfit offers an optional "Pro" subscription that unlocks full functionality, including starting new tracked shifts. Subscription purchases are processed entirely through Apple's App Store or Google Play, not directly by us.
ShiftProfit stores the data you enter locally on your device. We do not host or control this data on our own servers. You are responsible for your device's security (including your chosen PIN) and for backing up your own data if desired, as uninstalling the App or losing your device may result in permanent data loss. You agree not to misuse the App, including attempting to reverse-engineer, resell, or redistribute it, or using it for any unlawful purpose.
The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee the App will be uninterrupted, error-free, or free of defects.
To the fullest extent permitted by law, ShiftProfit LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or earnings, arising from your use of or inability to use the App, including reliance on any calculated estimates it provides.
We may update, modify, or discontinue features of the App at any time. We may also revise these Terms from time to time; continued use of the App after changes are posted constitutes acceptance of the updated Terms. Material changes will be reflected by updating the "Last updated" date above.
We reserve the right to suspend or discontinue your access to the App at our discretion, including for violation of these Terms.
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles.
